Gerichtsentscheidung: Neues geschlossenes Flüchtlingscamp rechtswidrig

Das neue Camp auf Lesbos in Vastria kann, so ein Gerichtsentscheid, so nicht in Betrieb genommen werden.
Das Camp Vastria liegt gut 30 km nördlich von der Inselhauptstadt Mytillini mitten im Wald und abseits jedweder Infrastruktur. Wie in Samos auch sollte es eine geschlossene, quasi gefängnisähnliche Anlage werden, was zu heftiger Kritik von Flüchtlings- und Menschenrechtsorganisationen führte.
Der parteilose Gouverneur des ostägäischen Inseln, Kostas Moutzouris, hatte gegen den Bau des Camps geklagt, weil er keine Lager auf den Inseln haben möchte. Dabei ging es um eine Genehmigung seitens der Umweltbehörde und die Frage, ob eine Zufahrtsstrasse genutzt werden dürfe:
In its application, the North Aegean Region argued that the project does not meet the conditions of legality under the applicable forest and environmental legislation and that the area to be built is in a Natura 2000 protected area and is protected by forest legislation.
Nun gab das oberste Verwaltungsgericht Griechenlands den Klägern Recht und entschied, dass das Camp so nicht in Betrieb genommen werden dürfe:
The Council of State, with the decision no. 1335/2023 of the E ́ Department, notified to the Legal Council of the State just three days ago, vindicated the North Aegean Region, as the State Councilors canceled the licensing of the project for lack of an environmental study and at the same time, annulled the approval of intervention in a forest area of 21,011 sq.m. in order to construct the access road to the structure.
Mit Erleichterung und Freude wurde diese Entscheidung von lokalen Hilfsorganisationen und auch den Flüchtlingen im Kara Tepe Camp aufgenommen, die einen Transfer ins neue Camp im Herbst fürchteten.
Finanziert wurde das Vastria Camp aus Töpfen der EU. Es ist so gut wie fertig gestellt und zu Recht stellen sich nun auch einige die Frage, wie die EU nicht nur dem Bau des Camps an so einem Ort zustimmen, sondern es auch noch finanzieren konnte, bevor juristische Fragen geregelt wurden.
